UK campaigners call on MoD to publicly release depleted uranium legal review
Following the revelation that the Ministry of Defence had been misleading MPs and campaigners over the legal status of the UK's CHARM3 DU munitions, the UK Uranium Weapons Network has formally requested that the new review be made public.

In November 2011, the armed forces minister Nick Harvey admitted in a parliamentary question that he had inadvertently misled MPs about a Ministry of Defence review that he said had concluded the weapons were permissible on humanitarian and environmental grounds under the Geneva conventions. He told his questioner Katy Clark MP on 26 October that. "Though incorrect, the statement in my letter was made in good faith on the advice of officials, and I apologise for the error."

The review is now taking place and is due to be completed at the end of February 2012. In the past legal reviews have never been published which means that they are not subject to any further analysis than the review board itself. To this end the Uranium Weapons Network, other interested NGO’s and cross party MP’s have written an open letter to Nick Harvey requesting that he make certain elements of the review available to the public.

Article 36 is a part of Additional Protocol I to the Geneva Conventions 1977. It states:

New weapons
In the study, development, acquisition or adoption of a new weapon, means or method of warfare, a High Contracting Party is under an obligation to determine whether its employment would, in some or all circumstances, be prohibited by this Protocol or by any other rule of international law applicable to the High Contracting Party.

Article 36 of Additional Protocol I was a very welcome addition to the Geneva Convention in that it provided a mechanism to ensure that states adhere to their responsibilities regarding international humanitarian law (IHL). However, it does not impose a formal procedure for conducting reviews, nor does it specifically state that a country has to publicise their reviews.

The UK ratified Article 36 in 1998 and as the UK’s 120mm CHARM3 DU tank munition entered into service in 1999, it became subject to this provision. The MoD has sent the Uranium Weapons Network a copy of their procedures for conducting an Article 36 review. This states the full extent of their obligations, including how and by whom the review should take place. Whilst it is one of only a few states that have set out a formal procedure for Article 36 reviews, it is our firm belief that in order for Article 36 to reach its true potential, the evidence and analysis contained within the review should be part of a more transparent process. Indeed the UK should take this opportunity to set a standard which we hope will be copied by other states.

In his letter to the Uranium Weapons Network on the 9th January, Nick Harvey stated that:

‘…the overall security classification of the review, since it deals with details of military capability, may prevent me from publishing it in its entirety. I have asked for an unclassified and releasable conclusion to be part of the review findings.’

We do not believe that ‘a releasable conclusion’ is sufficient to provide transparency and accountability to this review. Nor do we believe that it will allow for suitable scrutiny of the review board’s analysis and decisions. This is even more important considering that the review board is not an independent or impartial body.

Whilst we have acknowledged that some areas of the review may need to be restricted as they deal with details of military capability, there are parts for which this consideration would not be compromised and have therefore asked for the release of:

• Table of contents
• A list of evidence assessed
• Bibliography

There are also sections of the review that are vital to understanding the application of international humanitarian law to CHARM3:

• The section which takes into account its effect to persons, property and secondary effect
• The section which takes into account its impact on public health and the environment
• All information pertaining to whether CHARM3 is capable of being used discriminately
• All information pertaining to future trends in IHL

Further to this, in a written answer Nick Harvey stated:

‘The review conclusion will be published. Legal weapons reviews are privileged legal advice, and may be exempt from publication, as they concern details of military capability. These factors may prevent the publication of the full report.’

Despite the fact that the legal review team is made up of lawyers and therefore any advice they give is privileged, as a client Nick Harvey has the right to waive this privilege and should do so. This is supported by the considerable public concern over DU weapons, recently noted by the MOD in correspondence with the UWN:

“We acknowledge some public anxiety. We are conscious many people are concerned there is a link between the use of DU ammunition and medical problems such as cancers and birth defects. This is an issue taken very seriously by the Government. The cases of illness reported in Iraq and elsewhere are extremely distressing especially when they affect children.”

Further to this, the procedural document states ‘the lawyer conducting the legal review may need to engage widely’. However it does not place an obligation on him to engage widely, thus meaning that a lot of research may be missed. The Campaign Against Depleted Uranium has submitted a list of reports which they believe the review team need to consider when deciding on the legality of CHARM3. They do not have to accept our submissions but the only way we can check if they have done so, and check on what other research they have conducted, is for us to see the parts of the report we have requested.

Save Farnmland Rally February 25

Congrats to Kione Dudley and the many grassroots Community Committee for a great Farm Festival Rally at Kaka'ako Park today.

The location and facilities are prima, football size grass field and uka parking, and luas with toilet paper and running water wash basins! While the facilities were great the turnout was a disgrace to the blood, sweat and tears of all efforts of "homegrown" ka po'e. Three hundred in attendance is piss poor for all the dedication that was involved. And we wonder why the "establishment" keeps screwing us? As long as the screwed people hold still, they will keep getting only what we deserve.

You guys missed some good foods, fun and friends, and great music by Kupa'aina, Makana blessed us with songs and wisdom, as did Kawika Kahiapo, and a hot Bayou Band like the old Brown Derby with Trummy Young and Ernie Washington who is/was Nat King Cole's cus. I first heard King Cole at the Zebra Room on the corner of Young St. and Kalakaua Ave. in the 50's. E kala mai, but I did not get the name of another soloist Country Music artist who was great too.

Just good stuff on how we going to make it beyond Obamanism. As I departed I put gas in Kakaako at $4.31 (Shell) before I went holo. Then, I bought bread at Shima's (Waimanlo) at $4.58 a loaf. Apparently, most don't give a crap about existence.

There is a focus on Ho'opili and its great 1500 acre agriculture park, designed to pacify the additional 200,000 residents destine for Ewa. 1500 acres for agriculture is like pissing at the Pali Lookout. While at the rally, I was approach by Native American half breed wahine who ask me, "what is all this talk about not being able to keep Agriculture Land in Ag? My family have a 6000 acre farm in Kentucky. She said, "1500 acres is just for the animals". I told her, "we are the animals".

Agriculture or Aquaculture?

The people of Hawaii must understand self-sustainability is not in the aina. It is in the oceans of Ko Hawaii Pae Aina, the Hawaiian Archipelago which extends from South Point (Kau) to the Marine Sanctuary Papa'hanau'akeo'moku Northwest 1200 miles and extends 1,523. There are 132 islands in the Hawaiian Chain with only 7 of 8 being inhabitable. Recognize International navigation boundary is 200 miles which establishes the area of the Hawaiian Islands at 304,600 square (200 times 1,523) miles. The State of Texas is 268,000 square miles. The land area of the Hawaiian Islands is 6,459 square miles, less than 1 % of our actual boundary area. Ninety-eight percent of the area is under ocean water. The remaining 128 submerged islands are lava and coal base of the ocean that supports marine life and is very well the soil of our self-sustainable existence. 1500 ACRES ?? DisneyAina Resort?

Disneyland Park was started in 1954 via a 160 Acre Orange Grove in the city Anaheim, California. In the midst of Disneyland was a 58 acre strawberry farmer Fugishige. The 1500 Acre Agriculture Park of Ho'opili remains me of the Fugishige

Strawberry Farm in the midst of multi-billion Disney Empire. The Fugishige's were constantly at the end of complaints of their use of insecticides and fungicides, just as residents of Ho'opili and certainly the entire Ewa Plain.

I'm am totally surprised that you see this as a race issue, (American or Hawaiian born). This American president that we have in office, black, white, red, cocoa, doesn't make a damn difference either. What matters is that our families in Hawaii feel the repercussions of this A hole in the DC. office as much as the families in California, Pennsylvania, Japan, or England.

So, its does matter to all in Hawaii as well. Try not paying your fed. taxes. or Try to dig a fresh water well without telling state owned Hawaiian government. Take the food stamps away from those on welfare. Hell, as you well know, one can't keep a blue tarp over their driveway without a bunch of crap spewing from their mouth. This issue is much bigger than pinning blame on dole or whoever for their crimes.

Jees oh man, this is old news, of what these people did to take advantage of beautiful Hawaii nei. Your preaching to the choir. You need to read the book of Sun Tzu and get realistic. The Washington DC man keeps the Hawaiians so busy as each others neck the Hawaiians fail to see the real picture. The Federal Government is getting exactly what they want from those in Hawaii, to argue amongst themselves. Each having their own ideas of how to handle the illegal implants (fed gov't). Instead of just sitting together to fight the DC man with their own laws. Get the feds out, then the hawaiian people can decide who's the big dog.

Example, Go to K-bay JAG office and file a law suit against the DC man who swore to uphold his own law. For breach of Oath for one. I'm sure you can think of some other things as well. And the beautiful thing here is: it's free ! Yes, the lawyers on staff at the JAG office are already being paid to fight for by you and I and the millions of others via the Federal Taxes that we have been paying. All they do need (which is a very important part) is the pressure from the people they are supposed to be serving. You and I.

Perhaps the US Constitution doesn't apply in Hawaii lawfully but step outside your box and open the maka's, THEIR THERE. Until the people of Hawaii nei get rid of the feds, they will never be able to have their own lands back. Hell, the feds probably have one of their own running a group just to help keep things arguing amongest yourself. And they'll be the first to tell me how full of BS this email is. You watch.

There will be a town hall meeting on rail on Tuesday evening that will bring experts from the mainland to address Rail problems that we on the West Side will face. I heard Wendell Cox in an earlier symposium this year, and asked that he be brought back for this set of meetings (Another meeting will take place on Wednesday in Honolulu. The speakers will all testify before the Land Use Commission on Thursday).

The Rail folks have presented a number of meetings in Kapolei, telling us only what they wanted us to hear. This town hall meeting will open your eyes to the real facts. We are really fortunate that Small Business Hawaii Educational Foundation and American Dream Coalition have made these experts available to a Leeward audience. You will thank yourself for attending.

Most people of all jurisdictions are unindated with the term "Sovereignty". What is Sovereignty or who can be Sovereign?. We Hawaiian Nationals know well that Queen Liliu'okalani was not Sovereign for she was removed by an entity foreign to her Sovereignty. Why even Kings and Queens of the World must depend on others to safekeep their Sovereignty? To me Sovereignty is the most maligned English word in one's vocabulary. The simplest description of individual Sovereignty that I understand is a sovereign is someone that is of the ability to be independently sustainable of very own existence. But even the most powerful people in the world highly depend upon others to protect their sovereignty. Some scholars of reason claim sovereignty is a mere illusion, an individual want that can never be even the most powerful people in the world are depended upon others for their sustainability and substance. Sovereignty is possible only when a people or country are of common unity that is dependent upon each other and recognized by others other than themselves, as that of another independent Nation or Country or an International body of recognition, like that of Family of Nations or the United Nations.

God Almighty, the Creator of all was Sovereign and look what His Creation did to him? Is there a tangibility of any Sovereignty?

The people are the remnants' of Sovereign Nation or Country, for they are inherent sovereigns of themselves yet they may not have no subjects and for most part may not even have a land base. One of the basic fundamentals of Sovereignty is the collective right of a people to self govern. But being without subjects or a land base does not necessarily label them less sovereign for it only means they are less self-reliant. The overthrow of the Country Hawaii only removed control of the lands and resources but not its ownership, for its ownership was inherent of the people as proclaimed by the Monarchy. And it did not remove the people nor their political status. The 13 original colonies of the New World too became Sovereigns by conquest and ignored or removed the indigenous of the Americas and soon they became Sovereign States until 1871 when they became part of a Corporation without the knowledge of the Sovereigns. The majority of The United States of America was once a Sovereign Nation but it was never a Country. Its majority has not changed, in fact it has far increased yet their Sovereignty is questionable. Congratulations to The Descendants for being nominated for five Academy Awards and providing a fleeting glimpse to a part of Hawai`i’s story that is manifesting today in the Hawaiian independence movement.

Besides having to come to terms with his closest personal relationships, Matt King, played by George Clooney, is also forced to make a decision as the executor of a large family land trust on the island of Kaua`i.

In the end he decides not to approve a lucrative resort development on his family’s land, citing a deeper trust obligation to the lands. But left unsaid is the time-bomb about to explode in Hawai`i — the increasing problem of clouded land titles traceable to the illegal usurpation of the Hawaiian Kingdom in 1893.

Did You Know That Hawaii Is NOT A “State” Of The United States?

The claim that Hawai`i is a “state” of the United States of America is false. The truth is, the US flagrantly violated a slew of international laws to take over the Hawaiian Kingdom and annex it to the US— against the will of the people of Hawai`i.

In good faith, President Cleveland and Queen Lili`uokalani, as heads of their respective countries, negotiated an Executive Agreement in which the US pledged to restore the lawful government of the Hawaiian Kingdom. That pledge has yet to be fulfilled.

the scary part by Occupy America

The Katrina debacle was a warm-up act. So was the mortgage fraud with its 30 million foreclosures and resultant homelessness. So is the lifetime indebtedness of young people seeking a college degree. What is ahead is more of the above, multiplied by a million. What US banks did to third world countries for decades they are now doing to the people of western industrialized nations - including our own. Just as bankers lured millions into home loans they could not afford with malice aforethought, those same bankers lured nations into loans they could not afford. That is what they do and always have done. It was easier to ignore when those nations were Chile, Argentina, Brazil, Indonesia, Peru, Ecuador, Bolivia, Honduras, El Salvador, Guatemala, Panama, Nicaragua, the Dominican Republic and Uruguay. (See John Perkins' must-read book, "Confessions of an Economic Hitman". You will forgive me if I have omitted nations - the CIA and the bankers are relentlessly busy). Now many of those nations are prospering and free of indebtedness to US bankers - probably forever. (They barter oil for other commodities in order to avoid the US dollar completely). So what was a greedy banker to do? He had to find new victims.

At the center of this Armageddon are the banks on the dole from the Federal Reserve: JP Morgan (and its investment arm, Morgan Stanley), Goldman Sachs, Bank of America, Citibank and Wells Fargo, all of whom trade derivatives worth more than the GDP of the entire world. Their modus operandi is to lure nations into low-interest loans they know with certainty cannot be repaid, thus forcing bankruptcy and allowing them to storm in like a flock of vultures and seize every asset the nation has - every mine, railroad, monument and public utility - at pennies on the dollar; then drive up prices for a massive profit, forcing the population into ruinous poverty. That scenario was instigated and played out in every country listed above beginning in the 1960's, and it is being enacted now. Greece is only the most recent carcass. Next on their list: Italy, Spain, Portugal, Ireland, Belgium, France and finally, the United States, where the Fed has finally done it - printed money in excess of the entire GDP of America. (As of January of this year, the national GDP was 15 trillion and 816 million dollars; the national debt rose to 15 trillion plus 65 billion dollars.) Fed policy is confusing, even for those who follow it, but suffice it to say that if all of that newly- created cash had not been siphoned into stock and commodity speculation - ending up in the Cayman Island bank accounts of corporate CEO's and bankers - but instead had gone into the economy - jobs, education, clean energy and infrastructure - the entire debt situation would look much better, since millions more Americans would be paying income taxes and be off of the food stamp rolls.

Instead it is in the stock market, oil speculation and US treasuries. That is where they put it. The nefarious purpose of this blatant act is not to "stimulate the economy" (since little of it was invested in the economy) but to allow members of Congress and corporate insiders to sell out of their stock holdings at record highs (which they are doing) assuring them of infinite wealth, before the market crashes again, as it always does after these rigged market rises. Wonder why gasoline is now 4 dollars a gallon when world demand is in fast decline? It is the Fed. Again. Free dollars drive up the price of everything priced in it. (Free to bankers only. The rest of us pay between 8% and 30% for those same dollars) Dodd-Frank supposedly outlawed Goldman's oil speculation plots, but the law is not enforced. Why? Because the Republican House of Representatives refused to provide the funds to the regulatory body charged with enforcing the law. Their Plan B, their ace in the hole when all of this money printing fails? Global war, initiated by the bombing of Iran. Hey, it worked in 1940, didn't it? Doesn't war always end recessions?

Where is this plot headed? What is their final, final objective? Wealth in the trillions for that handful of bankers and slavery for the rest of us. In the end, JP Morgan and Goldman Sachs will own every inch of real estate and every hard asset on the planet. That is their objective. They will become the new Hitlers and Mussolinis of the planet, dictating their will to governments. They are well on their way. As European nations fall to bankruptcy they are sucking up the spoils of their financial war. In fact the prime ministers of Greece and Italy were just tossed out and replaced by (drum roll) Goldman Sachs bankers !! Unelected bankers now rule two European countries and are being given near-dictatorial powers in how they "restructure" the economies and sovereign debt of those nations.

The oligarchy rules on all fronts: Corporations now pay Chinese workers a dollar a day instead of paying union labor in the US a living wage. They have imported tech workers from India at half-price and Mexican labor to supplant the last unskilled workers left in the U S. The only remaining obstacle to the total enslavement of Americans is the public sector unions - unions that represent the only jobs that cannot be shipped to the slave factories of Asia. Look at the number of Republican state legislatures and Republican governors erasing those unions from existence at record speed, as they ram through "right to work for pennies" laws. They are not going to stop until every last nurse, teacher and policeman is working for a dollar a day, confirming a new normal of impoverished misery for America. Advanced college degrees will soon only be held by the children of the richest .01% of Americans. And the ultimate coup - The Fed stated in comments of its last meeting that it is planning to devalue the dollar by another 33% over the next twenty years. Mind you the dollar has already lost over 30% of its value, so that totals up to a 63% loss of purchasing power over a thirty year period.Translation: A Depression economy coupled with hyperinflation driving up the cost of living to unseen levels.

Okay. What do we do about this? Are we all just helpless pawns in this scenario, doomed to horrible lives? First of all, understand that A) the bankers at the center of this are evil and immoral and do not care a whit for the future of the planet or anybody on it. (See Thom Hartman's article on why CEO's and bankers get paid millions to do middle class jobs: Because they are sociopaths); and B) Nobody in Congress, the White House or the courts is interested in stopping them. They own Congress, the White House and the courts, so forget petitions and phone calls to your reps. They don't care either. (There are exceptions - Congresswoman Marcy Kaptur, for one, described the bank bailout as a "financial coup d'etat" carried out in the middle of the night without consent of Congress). I would go further. It was a hold-up. Hank Paulson pointed a gun at Barney Frank's head and threatened to pull the trigger unless he handed over every last dime in the United States Treasury. When the House voted down the bailout, he held true to his threat and tanked the Dow another 700 points overnight. In the end, Paulson got every last dime in the US treasury. And since he was not required to account for what he did with it, we can only assume it went to bonus pay for the bankers who destroyed the lives of 350 million Americans.

So what do we do? The obvious solution is to throw most elected reps out of office in the next election. That assumes that voters are allowed to vote, which means voters must carry the specific forms of photo ID their state now requires; and that assumes that electronic voting machines without paper receipts are actually counting votes and not making up numbers out of fantasy. (To vote at all in the state of Georgia is a total waste of time. There has not been an honest election in Georgia in twelve years.) That also assumes that the vote totals will not be wired into Republican National Headquarters to be altered before they are published, as happened in the 2004 presidential election. Big assumptions.

We need Tahrir Square. I recall a segment on CNN when Occupy Wall Street first hit the media. A reporter on the scene was asked, "Is this Tahrir Square?" He responded, "Oh, no. Nothing like that. Just a bunch of frustrated kids. Nothing to worry about". Nothing for who to worry about? The bankers at Goldman Sachs? Yes, that is what he meant. We need to give them something to worry about. They actually are terrified of us, the people. Why else cancel Posse Comitatus and build all of those concentration camps around the country? Why else pass legislation nullifying all rights guaranteed to the people by the US constitution, including habeas corpus and the right to a trial? Yes, we need to give them something to worry about. How many millions in the street will that take? Many. Many millions. And all of that must happen before this next election. If the relatively discrete demonstrations of the Occupy movements changed the conversation in Washington and led Obama onto a new path, what would a Tahrir Square accomplish? Much more.

And there must be demands. Not only "break up the big banks " but shut them down and send the bankers to prison. Not only limit corporate bribes to campaigns, but remove ALL money from the electoral process and enact a law providing for publicly-funded elections. Not "reform" gerrymandering but eliminate it; Not add paper receipts to voting machines, but throw out ALL voting machines installed since Bush's hilariously-named "Help America Vote Act" corrupted the electoral system. Return to mail-in ballots or hand-written, hand-counted ballots, ballots that must be counted with representatives of all candidates present. Lastly we must dissolve the Federal Reserve and return to sound money printed by the US Treasury, not by a small group of private banks.

If we could accomplish those goals, before the election, we would not have to eliminate lobbyists because they would disappear. There would no longer be a reason for them to exist. As it currently stands, to call America a democracy is a joke and a lie. The people have NO say whatsoever - about any decision made in government. The corruption of all three branches of the US government is total and endemic. They are rotten and drowning in maggots. We need to get our say back. We need a real democracy. Will that take a full-out revolution? I hope it does not come to that. As Occupy Wall Street's Jesse LaGreca said in my interview with him published here, click here; "Revolution is off the table". We will face what comes. Or we will leave. But if we, the people, lose this battle and they, the bankers, win, it will hardly be worth staying alive.

Red Dwarf Stars May Be Best Chance for Habitable Alien Planets

Stars known as red dwarfs might have larger habitable zones friendly to "life as we know it' than once thought, researchers say. Red dwarfs, also known as M stars, are dim compared to stars like our sun and are just 10 to 20 percent as massive. They make up roughly three-quarters of the stars in the galaxy, and recently scientists found red dwarfs are far more common than before thought, making up at least 80 percent of the total number of stars. The fact that red dwarfs are so very common has made astrobiologists wonder if they might be the best chance for discovering planets habitable to life as we know it. More and more planets are getting discovered around red dwarfs -- for instance, a potentially habitable "super-Earth" at least 4.5 times the mass of Earth, GJ 667Cb, was recently found orbiting the red dwarf GJ 667C.

IBM snaps an image of electric charge

IBM researchers have created a subatomic snapshot of the electric charge within a molecule, an advance that could have applications in ever-smaller transistors or in solar power. Scientists from IBM Research in Zurich, Switzerland, published a paper in Nature Nanotechnology today that describes a technique for measuring how electrons move when forming molecular bonds. This method allows them to create images of how the electric charge is distributed within molecules, giving science a better picture of chemistry at the molecular level, said Fabian Mohn, who coauthored the paper. Having a picture of the electric charge distribution could be useful tool for research on making tiny transistors the size of a molecule or developing solar cells from inexpensive organic materials, he said.

Japanese Company Aims for Space Elevator by 2050

People could be gliding up to space on high-tech elevators by 2050 if a Japanese construction company's ambitious plans come to fruition. Tokyo-based Obayashi Corp. wants to build an operational space elevator by the middle of the century, Japan's Yomiuri Shimbun newspaper reported Wednesday (Feb. 22). The device would carry passengers skyward at about 124 mph (200 kph), delivering them to a station 22,000 miles (36,000 kilometers) above Earth in a little more than a week.
